This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Our personal data processing activities are governed by the Mauritius Data Protection Act 2017 (the”DPA”) and relevant regulations (the “DP Legislation”). According to DPA, we are in general the ‘Data Controller’ of all personal data obtained by us as set out in this Site. By accessing and continue using this Site, you consent to the Fund collecting, processing, disclosing, transferring (including cross-border) and storing personal data relating to you for the purpose of servicing your investment in the Fund and any obligations under the material agreements of the Fund.
‘Personal data’ is any information relating to you and that can be used to identify you, including your name, identification number, location data, an online identifier, or any other data that could reveal your physical, physiological, generic, mental, economic, cultural or social identity.
When you visit or otherwise use the Site we may collect and process the following data about you:
- details (including time, location, frequency) of your visits to the Site;
- personal data and information that you provide by filling in forms on the Site.
- using the dealing service available on the Site or requesting further information;
- details of transactions you carry out through the Site; and
- any correspondence between us and you.
This information is collected and processed
- for the performance of the contract with you;
- for the conclusion and performance of a contract made in your interest between us and third party;
- where you have notified us of your financial or investment adviser, the personal information provided to us may be shared with that adviser. You should notify us if you no longer wish personal information to be shared with your adviser or of any change in the adviser;
- for the establishment, exercise or defence of a legal claim;
- when we are under a duty to disclose to comply with any legal or regulatory duty and obligation. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction; and/or
- for the purpose of our legitimate business interests (subject to your rights), namely to analyse the use of our Site and services in order to continually improve our business and services
in accordance with DP Legislation.
We are committed to protecting the confidentiality and security of your personal information in accordance with DP Legislation. We take steps to protect your information from unauthorised access and against unlawful processing, accidental loss, destruction and damage. We will only keep your information for as long as we reasonably require and, in any event, only for as long as DP Legislations allows.
The information that we collect from you may also be transferred to, and stored at, a destination outside Mauritius. It may also be processed by staff operating outside Mauritius who work for us or for one of our suppliers. This includes staff engaged in, among other things, the processing of your payment details and the provision of support services. By submitting your personal data, you are acknowledging this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your information is treated securely and in accordance with this privacy policy and the DP Legislation. This means that we will only transfer your information to third parties that (a) are in countries with proof of appropriate safeguards with respect to the protection of the personal data/information; or (b) with your explicit consent hereto, have agreed to provide all protections to your personal information.
